Terms & Conditions

These Terms & Conditions (“Terms”) are an agreement between you and Jhakaas Digital Pvt. Ltd. and govern your access to the Jhakaas website, applications, streaming service, advertiser portal, and related features (together, the “Service”).

By creating an account, accepting these Terms, or using the Service, you agree to them and to our Privacy Policy. If you do not agree, do not use the Service. Additional terms shown for a purchase, promotion, advertiser order, or specific feature also apply to that activity; if they conflict with these Terms, the more specific terms control for that activity.

You must be legally capable of entering into this agreement. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms and supervise your use. Advertiser and business workspaces are for adults authorised to act for the relevant organisation.

You must provide accurate information and must not create an account for someone else without authority.

• Keep your email account, device, session, and one-time passwords secure. Never share an OTP with another person, including someone claiming to be Jhakaas support.
• You are responsible for activity through your account unless applicable law provides otherwise.
• Tell us promptly at support@jhakaastv.com if you suspect unauthorised access.
• We may require re-verification, end active sessions, or restrict access where reasonably necessary to protect the Service or its users.

Subject to these Terms, Jhakaas grants you a limited, personal, non-exclusive, non-transferable, revocable right to access available viewer content for private, non-commercial viewing through supported features and devices.

Content availability, language, classification, episodes, release timing, resolution, advertising, and supported devices may change. Offline downloads, where available, are temporary, may be device-limited, and may require periodic licence verification. Buying access to a service or earning a reward does not transfer ownership of content or platform software to you.

You must not:

• copy, rebroadcast, publicly perform, sell, rent, scrape, or redistribute content except where we expressly permit it;
• circumvent digital-rights management, access controls, geographic restrictions, security measures, or usage limits;
• reverse engineer or interfere with the Service except to the limited extent applicable law expressly permits;
• use bots, automation, deceptive traffic, or manipulated devices to inflate views, rewards, advertising events, or campaign results;
• upload malware, unlawful material, infringing content, or content that violates another person’s privacy or rights;
• impersonate another person, misrepresent an organisation, or submit false tax, identity, payment, lead, or campaign information; or
• use the Service in a way that is unlawful, abusive, harmful, or disruptive to others.

The Service may contain advertising, sponsorships, branded content, or links to advertiser experiences. Advertisers are responsible for their claims, offers, products, and destinations. Jhakaas may review or reject advertising and may use privacy-protected delivery and performance information. If you choose to submit a lead form or engage with an advertiser, the advertiser’s own terms and privacy practices may apply after the information is shared as explained at the point of collection.

Jhakaas may offer points, referrals, promotional credits, or other benefits. Unless a specific offer clearly says otherwise, these benefits are promotional, have no cash value, are not a bank balance, and may not be sold, transferred, or withdrawn.

Offer-specific eligibility, limits, expiry, and redemption rules may apply. We may correct errors or withhold benefits connected to fraud, abuse, manipulated activity, or a breach of these Terms, while respecting applicable consumer rights.

Where Jhakaas offers a paid product or advertiser service, prices, taxes, billing events, validity, and material purchase terms will be shown at checkout, in an order, or in a separate agreement. You authorise the applicable payment provider and Jhakaas to process the transaction you request.

Cancellation and refund eligibility depends on the product, delivery status, specific offer or order, and applicable law. See our Cancellation & Refund Policy for the request process. Nothing in these Terms limits a mandatory consumer right. For billing help, contact support@jhakaastv.com; advertisers may use their protected support workspace.

If you use an advertiser workspace, you confirm that you are authorised to act for the named organisation. You are responsible for business, tax, campaign, creative, targeting, destination, consent, and billing information submitted through that workspace.

You must hold the rights and permissions needed for campaign materials and claims, and must comply with advertising, consumer, intellectual-property, privacy, sector-specific, and other applicable laws. Jhakaas may require verification, review creatives, pause delivery, reject materials, or suspend access to protect audiences, the Service, or legal compliance. Campaign orders, rate cards, and separately agreed business terms may add to these Terms.

Jhakaas, the platform design, software, logos, artwork, metadata, and content made available through the Service are owned by Jhakaas Digital Pvt. Ltd. or its licensors and are protected by applicable law. Except for the limited rights expressly granted in these Terms, no right, title, or interest is transferred to you. Feedback you voluntarily provide may be used to improve the Service without a duty to compensate you, but we do not claim ownership of personal data merely because you submit it.

The Service may rely on or link to third-party payment, app-store, device, communication, or advertiser services. Their terms and privacy policies govern your direct use of those services. Jhakaas is not responsible for a third party’s independent service, but this does not remove any responsibility that applicable law places on us.

You may stop using the Service at any time. We may restrict, suspend, or terminate access where reasonably necessary because of a material breach, fraud, security risk, legal requirement, non-payment, misuse, or discontinuation of a feature. Where appropriate, we will provide notice or an opportunity to resolve the issue. Provisions that by their nature should continue—including intellectual-property, payment, dispute, and liability provisions—survive termination.

We work to provide a reliable Service, but availability may be affected by maintenance, networks, devices, content rights, security events, or circumstances outside our reasonable control. To the extent permitted by law, the Service is provided on an “as available” basis without warranties that every feature or item of content will always be uninterrupted or error-free. Nothing here excludes a warranty, remedy, or right that cannot lawfully be excluded.

Each party remains responsible for losses it causes in accordance with applicable law. To the extent permitted by law, Jhakaas Digital Pvt. Ltd. is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when you accepted these Terms. These limitations do not apply to fraud, wilful misconduct, liability that cannot be limited, or mandatory consumer remedies.

These Terms are governed by the laws of India. Courts with jurisdiction under applicable law may hear disputes. Before starting formal proceedings, please contact us so we can try to resolve the issue; this does not prevent either party from seeking urgent relief or using a consumer or statutory remedy.

We may update these Terms to reflect service, business, or legal changes. We will post the revised Terms, update the effective date, and provide additional notice where a material change or applicable law requires it. Your continued use after revised Terms take effect means you accept them, unless the law requires a different form of agreement.
